Client Care Cards, LLC is herein referred to as “CCC”

Realtor & Mortgage Follow Up, Client Follow Up, Circle of Influence, and Birthday Card Program

Card Service details. All cards are hand signed, customer's business card enclosed (if provided) and envelopes personalized with customer's return address, and commemorative postage. Circle of Influence greeting cards have personalized name imprint on the inside of card.
Realtor Follow UP- is a subscription program of greeting cards mailed every six months for a period of three years. The program costs $22.99 per client.
The Mortgage Follow Up is a subscription program of greeting cards mailed annually for a period of three years.
The program costs $12.99 per client.

Birthday Program- is a subscription program of greeting cards mailed out annually for a period of three years.
Cards are mailed out about 7-10 days before your client’s birthday. The program costs $9.99

Client Follow Up- is a subscription program of greeting cards mailed every six months for a period of three years. The program costs $22.99 per client.

Circle of Influence- You pick out the cards and months that your clients receive cards. They are prescheduled for one year. Because cards are mailed on a scheduled basis & ordered approximately 1 ½ months before the mail date; any necessary changes require at least a 45 day notice.

Basic Charges for the Circle of Influence Program are based on the price schedule below. Lists of less than 50 can be accepted, but will be charged for 50 cards.
Prices below reflect the cost per card and for 1 mailing. Postage is additional.

Example (50 cards mailed out on the quarterly program -$1.66 x 50 cards= $83.00 plus add the cost of stamps (.44 currently). Total cost for one mailing = $105.00
Quarterly program calculated for the whole year $105.00 x 4= $420.00
 
Other Charges regarding Circle of Influence: Initial List Data Entry $.25 per name or $15.00 for Disk Importing/Computer Upload.
Miscellaneous Charges include Card resend request $l.50, Zip Code Research $.25 (US Postal Service FREE Zip Code information 1-800-275-8777 or usps.com).

Customer Appreciation:

Referral Bonus-Customer will receive a $25.00 in-house credit or $20.00 gift card for each referral that results in sign-up of a new customer.
Birthday Card Program- 5% off for each additional family member mailed to the same address
Sign up Bonus-1 free program if you put 10 clients on at the time of sign up (for Realtor, Mortgage, client follow up, and Birthday Card programs only)

Billing. Customer’s credit card will be charged for all charges associated with greeting card mailings and products purchased, and for all amounts that are owed to Client Care Cards, LLC, and Customer hereby agrees to such charges to be allowed against the Customer’s credit card.

Price Increases. Future subscription prices are subject to increases in postal rates, cost of goods, etc., and increases shall take effect at time of such costs increases upon Client Care Cards, LLC.

Card Substitution- Client Care Cards, LLC reserves the right to substitute a reasonably similar card without notification to the Customer if a card is out of stock for a particular program.

Cancellation Policy for Circle of Influence. If a customer wants to cancel a mailing(s), there is a $75.00 cancellation fee each time. If customer wants to discontinue their mailings all together on the Circle of Influence Program, there will be a $175.00 cancellation fee to end their program. Such cancellation notices must be received in writing from the Customer and cancellation will not be granted until receipt of that notice. Customer will be charged for all amounts owed to Client Care Cards, LLC up to the date of cancellation.

Drop Client. If a customer wants to drop a client from the Realtor, Mortgage, Client follow up or Birthday program at any point during the subscription, Client Care Cards will discontinue any further mailings and grant a $2.00 per card in-house credit on all cards not yet mailed.
Confidentiality. Client Care Cards, LLC shall keep all client information received from customer confidential and shall not use such information for any other purpose other than for the production and mailing of greetings cards set forth above.

Client Care Cards, LLC is not responsible for change of addresses of the mailing recipients if no return address is provided after mailings. Customers shall keep us immediately apprised of any change in addresses of the mailing recipients as the Customer becomes aware of them. Customer hereby confirms to CCC that the recipient of the mailings has not indicated in any manner to Customer that they do not wish to receive any mailings from Customer, and Customer is authorized to mail cards and other promotional material to the mailing recipient without violation of any of the mailing recipient’s rights or wishes as understood by Customer.

INDEMNIFICATION:
The Customer shall defend, indemnify, and hold harmless, CCC and CCC’s representatives, agents, owners, officers, directors, managers, employees and members from and against all claims, demands, liabilities, causes of action, suits, judgments, damages and expenses (including, but not limited to, attorneys fees, expert witness fees, court costs, and expenses) arising from any loss arising from any occurrence alleged to be caused by the actions or omissions of Customer or Customer’s agents, employees, representatives, officers, directors, owners, servants, or members. This indemnity shall also apply to any act committed by the Customer, or any omission to act by the Customer, in regards to the work of CCC on behalf of the Customer. This indemnity is intended to indemnify CCC from Customer’s, or others’ as named above, negligence, actions or omissions. This indemnity provision shall survive termination or expiration of this CCC’s services for Customer. If any proceeding is filed for which indemnity is required hereunder, Customer agrees, upon request by CCC, to defend CCC in such proceeding at Customer’s sole cost utilizing counsel satisfactory to CCC. CCC is not responsible for Customer’s decision to direct CCC to send mailings to the recipients of the mailings and the Customer shall defend, indemnify and hold harmless CCC for any claims arising from Customer’s decision to hire CCC to send mailings to persons or entities of Customer’s choice.

FORCE MAJEURE:
Whenever a period of time is herein prescribed for action to be taken by CCC, CCC shall not be liable or responsible for, and there shall be excluded from the computation of any such period of time, any delays due to strikes, riots, acts of God, shortages of labor or materials, war, government laws, regulations, or restrictions, or any other causes of any kind whatsoever which are beyond the control of such party.

ENTIRE AGREEMENT:
This agreement constitutes the entire agreement between CCC and Customer regarding CCC’s services and supersedes all oral statements and prior writings relating thereto. Except for those set forth in this agreement, no representations, warranties, or agreements have been made by CCC to the Customer with respect to this agreement or CCC’s services.
